SELLING DURING PROBATE
How long does the probate process take?
Every probate case can vary depending on its size and issues. An experienced probate attorney can provide a more accurate time frame, but most cases take more than 6 months, and sometimes years.
Can we sell the real property during probate?
Yes, many times, this benefits the estate because there are less California disclosure requirements. This is because in most cases, the Personal Representative knows very little, if anything at all, about the real property in the estate.
Should we sell the real property after probate?
It is an option to sell the real property after the probate case. However, often times, the property has to be sold to satisfy creditors, to divide assets among the heirs, or because costs of maintenance and management of the property creates a burden to the family. What do we have to do to the house to get it ready for market?

What if neither I nor the family has the money to get the house ready for sale?
Often times, the estate does not have the funds to address major issues (i.e. mold remediation; junk hauling) or even, cosmetic issues (i.e. paint; yard cleanup). On a case by case basis, the Kurniadi Group is able to advance funds necessary to clean, market, and sell the probate property.
I live far from the property and the estate. Can Kurniadi Realty help sell the property remotely?
Yes, many of our clients live outside of the San Diego Area or in other states. We are committed to serving our out-of-town clients by preparing the probate property from the cleanout stage to the close of escrow of the sale.
